Discussion in the transfer of a domain name? Or you wish to register a domain name but it is no longer available? You find that you are entitled to a certain domain name? If the domain you wish to claim has been registered or is being used  in a fraudulent way, there are some options to claim it (back).
It is of course highly recommended to first contact the owner of your desired domain name. If this fails, you can use an ADR procedure (a mediation process at CEPINA). A final option is to sue the opposing party under the law of June 26, 2003 concerning the abusive registration of domain names. If you are caught up in a discussion around domain names, or you simply want to claim a previously registered domain, we offer a preliminary advice. If desired, we can assist you further in contact with the domain holder and / or in implementing a ADR procedure.

What does cybersquatting and typosquatting mean?

Cybersquatting and typosquatting are two techniques related to domain name registrations, they are completely separate from the content of websites. A cybersquatter registers domain names identical to well known trademarks, to trade these domains simply for the purpose to harm the brand name holder or sell the domain with huge profits. Cybersquatting, depending on the specific case, is an unlawful registration within the meaning of Article 10 of the Terms of DNS.BE and the Act of June 26, 2003 concerning the abusive registration of domain names. Under Article 10 of the Terms of DNS BE a process may be initiated at CEPINA because of the unlawful registering of.be domain names. Please contact us for more information on the dispute. On the other hand, the Act of June 26, 2003 i implies the possibility to go to court. [1]
