ASP/SaaS agreements
ASP means Application Service Providing and is also called SaaS (Software as a Service).
The Application Service Provider is a company that offers the opportunity for enterprises to use software on the Internet. Therefore, the customer no longer have to purchase expensive software and pays only for actual use. The software is not installed locally, given it's accessed via the Internet. Software as a Service (SaaS) is a new form of ASP. The difference with SaaS is that the end-user uses the software via a Web browser (Internet Explorer, Firefox, Safari, Chrome, ...). In addition, the vendor can implement updates and upgrades from a central location.
Given that the data is not stored locally, an ASP contract is vital, especially in terms of privacy protection. Anno 2010, Cloud Computing is becoming increasingly popular so clear agreements with the supplier’s liability for loss of data, privacy etc. are an absolute necessity.
